Compensation Survey Disclaimer and Release of Liability
By participating in any voluntary market research survey or compensation survey conducted by ABF Global Search, Inc. (c) agree that this release and waiver is intended to be as broad, inclusive, and comprehensive as the maximum extent permitted under applicable law in every relevant jurisdiction, and shall be construed in favor of the Released Parties to achieve the fullest possible protection;
(d) expressly waive any and all rights, protections, or benefits under any statute, common law principle, equitable doctrine, or rule of construction that would limit the scope, effect, or enforceability of this waiver, including without limitation California Civil Code § 1542 (or any substantially similar or analogous provision in any other jurisdiction), which provides: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” You expressly waive application of any such provision and agree that this release shall apply to all claims whether presently known or unknown.

This release and waiver shall survive any termination of your participation, access to the survey, or dissolution of ABF Global Search, Inc., and shall be binding on you, your heirs, executors, administrators, successors, assigns, and any other person claiming by or through you.
